Welcome to Mariner's Spirit. These Terms of Service (“Terms”) govern your access to and use of marinerspirit.com (the “Site”) and any purchases made through it. By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Refund Policy.
If you do not agree, please do not use the Site or purchase our products.
1. Who we are
The Site is operated by Mariner's Spirit Supply Co. (“Mariner's Spirit,” “we,” “us,” or “our”), a company based in British Columbia, Canada. Business contact details are listed in our Contact Information policy.
2. Eligibility
You must be at least the age of majority in your province, state, or country to use the Site and make purchases.
Alcohol purchases: You must be of legal drinking age in your jurisdiction to purchase alcohol:
- Canada: 18 or 19, depending on province or territory
- United States: 21
- United Kingdom: 18
By ordering alcohol, you represent that you and any recipient are of legal drinking age and that delivery to your address is permitted by law. We may refuse or cancel orders where age, identity, or delivery eligibility cannot be verified.
3. Account registration
Some features require a customer account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at admin@marinerspirit.com if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or applicable law.
4. Products, pricing & availability
We sell spirits, merchandise, Founders Circle contributions, and other offerings described on the Site. Product images, descriptions, tasting notes, release details, and availability are subject to change without notice.
- Limited releases may sell out without restock.
- Pre-orders reserve access to a future release and may ship later than in-stock items. Estimated fulfillment dates are estimates only.
- Shipping regions: We ship to Canada, the United States, and the United Kingdom where permitted by law. Product availability may vary by destination.
- Prices are shown in the currency displayed at checkout and may change before you complete payment.
- We reserve the right to limit quantities, refuse orders, or cancel orders placed in error, including pricing or listing mistakes.
5. Orders & payment
When you place an order, you offer to purchase the selected products subject to these Terms. An order is accepted when we send order confirmation or when we begin fulfillment, whichever comes first.
Payment is processed securely through Shopify and its payment providers. You authorize us to charge your selected payment method for the total amount shown at checkout, including applicable taxes, shipping, and duties where disclosed.
For orders shipped to the United States or United Kingdom, import duties, VAT, or other customs charges may apply. Unless stated otherwise at checkout, you are responsible for any charges assessed on delivery.
6. Founders Circle & member access
Founders Circle contributions are one-time payments that may unlock member pages, communications, and early access opportunities. Unless clearly stated on the product page, a contribution is not a product pre-order, investment, or guarantee of future product allocation.
Member benefits, content, and access levels may change over time. We will use reasonable efforts to communicate material changes to active members.
7. Crew applications
If you pay a crew application fee, you submit an application for employment consideration only. The fee does not guarantee review timing, interview, or hire. Application fee terms are described in our Refund Policy.
Information you submit through employment or crew forms must be accurate. We may use it as described in our Privacy Policy.
8. Shipping, delivery & returns
Shipping regions, processing times, international delivery, age verification, and adult signature requirements are described in our Shipping Policy. Returns and refunds are described in our Refund Policy.
9. Acceptable use
You agree not to:
- Use the Site for unlawful purposes or to violate any applicable law or regulation
- Attempt to circumvent age verification, purchase limits, or regional restrictions
- Scrape, reverse engineer, or interfere with the Site’s operation or security
- Submit false, misleading, or fraudulent information
- Resell alcohol or restricted products in violation of licensing law
10. Intellectual property
All content on the Site—including logos, branding, photography, video, copy, product names, and design—is owned by Mariners Spirit or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or exploit Site content without our prior written permission.
11. Third-party services
The Site may integrate third-party tools such as payment processors, analytics, email marketing, print fulfillment, or form providers. Your use of those services may be subject to their own terms and privacy practices, as described in our Privacy Policy.
12. Disclaimers
The Site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant uninterrupted access to the Site or that product descriptions, release timing, or fulfillment estimates will be error-free.
Alcohol must be consumed responsibly and only by those of legal drinking age.
13. Limitation of liability
To the fullest extent permitted by applicable law, Mariner's Spirit Supply Co. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.
Our total liability for any claim relating to a product or these Terms will not exceed the amount you paid to us for that product in the 12 months preceding the claim, except where such limitation is prohibited by law.
14. Indemnification
You agree to indemnify and hold harmless Mariner's Spirit Supply Co. from claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Site, or unlawful purchase, receipt, or consumption of alcohol.
15. Governing law & disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada, except where consumer protection law in your country of residence requires otherwise.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top will reflect the latest version. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
